OVERVIEW

This website is operated by VLS Trading Ltd, trading as Berstuk Store. Throughout the site, the terms "we", "us" and "our" refer to Berstuk Store. We offer this website, including all information, tools and services available from it, to you, the user, conditioned on your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site or buying something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional terms and policies referenced here or available by hyperlink. These Terms apply to everyone who uses the site, including browsers, customers and contributors of content.

Please read these Terms carefully before using the site. By accessing or using any part of the site, you agree to be bound by them. If you do not agree to all of them, you may not access the site or use any Service.

Any new features or tools added to the store are also subject to these Terms. You can review the current version at any time on this page. We may update, change or replace any part of these Terms by posting the change to this page. Your continued use of the site after a change is posted means you accept it.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms you confirm that you are at least the age of majority in your state of residence, or that you are the age of majority and have given consent for any minor dependant of yours to use this site.

You may not use our products for any unlawful purpose, and you may not use the Service in a way that breaks the law in your jurisdiction, including copyright law. You must not transmit any worm, virus or code of a destructive nature. A breach of these Terms results in immediate termination of your access to the Service.

SECTION 2 - GENERAL CONDITIONS

We may refuse service to anyone for any reason at any time. You understand that your content, not including payment card information, may be transferred unencrypted and may involve transmission across various networks and changes to meet technical requirements. Payment card information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service or any content on the site without our written permission. Section headings are for convenience only and do not affect the meaning of these Terms.

SECTION 3 - CONSENT TO COOKIES AND ANALYTICS

You acknowledge and agree that the site uses cookies, tags, pixels and similar technologies, and that we and the service providers acting on our behalf may collect information about how you interact with the site. This includes the pages you view, the links and buttons you click, the terms you enter into our site search, and the technical details of your device and connection. Some of this is collected and processed by third party service providers on our behalf, as described in our Privacy Policy.

Non essential cookies and analytics do not operate until you accept them on our cookie banner, and you can withdraw your acceptance at any time using the cookie preferences link in the site footer. We honour opt out preference signals, including Global Privacy Control.

We are not responsible if information on this site is not accurate, complete or current. The material is provided for general information only and should not be used as the sole basis for a decision without consulting more accurate, complete or timely sources. Any reliance on it is at your own risk. This site may contain historical information, which is provided for reference only. We may modify the contents of the site at any time, but we are under no obligation to update any information on it.

Prices are subject to change without notice. We may modify or discontinue the Service, or any part of it, at any time without notice. We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

SECTION 6 - PRODUCTS AND SERVICES

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your screen will display a colour accurately. Natural materials, including wood and paper, vary in grain and shade from piece to piece.

We may limit the sale of our products to any person, geographic region or jurisdiction, and we may limit quantities. All product descriptions and prices may change at any time without notice. Any offer made on this site is void where prohibited. We do not warrant that the quality of any product or service you buy will meet your expectations, or that errors in the Service will be corrected.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse any order you place with us, and we may limit or cancel quantities bought per person, per household or per order. These restrictions may apply to orders placed under the same customer account, the same payment card, or the same billing or shipping address. If we change or cancel an order, we may contact you using the email address, billing address or phone number given when the order was placed. We may limit or prohibit orders that in our judgement appear to be placed by dealers, resellers or distributors.

You agree to give current, complete and accurate purchase and account information for every purchase, and to update it promptly so that we can complete your transactions and contact you when needed.

SECTION 8 - OPTIONAL TOOLS

We may give you access to third party tools that we neither monitor nor control. You agree that such tools are provided "as is" and "as available" with no warranty, representation or endorsement of any kind, and that we have no liability arising from your use of them. Any use of those tools is at your own risk, and you should satisfy yourself that you are happy with the terms on which the relevant third party provides them.

Content, products and services available through our Service may include material from third parties. Third party links on this site may take you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we accept no liability for any third party material, website, product or service. SECTION 10 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

You agree that your comments will not infringe any right of any third party, including copyright, trademark, privacy or personality rights, and will not contain unlawful, abusive or obscene material or any malware. You may not use a false email address, pretend to be someone else, or mislead us about the origin of any comments. You are solely responsible for your comments and their accuracy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains a typographical error, inaccuracy or omission relating to a product description, price, promotion, offer, shipping charge, transit time or availability. We may correct any such error and may change or update information or cancel an order if any information was inaccurate, at any time and without prior notice, including after you have submitted your order. We are under no obligation to update or clarify information on the site except as required by law.

SECTION 13 - PROHIBITED USES

In addition to the other prohibitions in these Terms, you are prohibited from using the site or its content: for any unlawful purpose; to solicit others to perform an unlawful act; to violate any international, federal, state or local regulation, rule, law or ordinance; to infringe our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone; to submit false or misleading information; to upload or transmit malicious code; to collect or track the personal information of others; to spam, phish, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Service or any related website. We may terminate your use of the Service for breaching any of these prohibitions.

SECTION 14 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error free, or that the results obtained from using it will be accurate or reliable. We may remove the Service for indefinite periods or cancel it at any time without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products delivered to you through it are, except as expressly stated by us, provided "as is" and "as available" without representation, warranty or condition of any kind, express or implied, including all implied warranties of merchantability, fitness for a particular purpose, durability, title and non infringement.

In no case shall Berstuk Store, VLS Trading Ltd, or our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, whether based in contract, tort including negligence, strict liability or otherwise, arising from your use of the Service or of any product bought through it, even if advised of the possibility. Where a jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In every case, our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or 100 US dollars, whichever is greater.

SECTION 15 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Berstuk Store, VLS Trading Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 16 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is still enforceable to the fullest extent permitted by law, and the unenforceable part is severed from these Terms. That finding does not affect the validity or enforceability of the remaining provisions.

SECTION 17 - TERMINATION

Obligations and liabilities incurred before the date of termination survive termination for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by telling us you no longer wish to use our Services, or by ceasing to use the site. If we judge that you have failed to comply with any provision of these Terms, we may terminate this agreement at any time without notice. You remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services.

SECTION 18 - DISPUTE RESOLUTION, ARBITRATION AND CLASS ACTION WAIVER

18.1 Talk to us first. Most problems can be sorted out quickly. Before starting arbitration or any other proceeding, you agree to send us a written notice of dispute to info@berstukstore.com with the subject line "Notice of Dispute", and to the postal address at the end of these Terms. The notice must give your name, the email address and postal address associated with your order, a description of the dispute, and the relief you are seeking. We will send you the same information if we have a dispute with you. Both of us agree to try in good faith to resolve the dispute informally for 60 days from the date the notice is received. This informal process is a condition that must be completed before either of us may start arbitration, and the time limit for bringing a claim is paused while it runs. A court may enjoin the filing of any proceeding brought before this process is complete.

18.2 Binding individual arbitration. If we cannot resolve the dispute informally, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms, the site, our products, our advertising, or the collection or use of your information, including the validity, enforceability or scope of this Section 18, will be resolved by final and binding individual arbitration, and not in court. This agreement to arbitrate is governed by the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, which are available at https://www.adr.org. The arbitration will take place in the county where you live, or by telephone or video, or on the documents alone, at your choice. The arbitrator may award the same individual relief that a court could, and the arbitrator's decision may be entered as a judgment in any court with jurisdiction.

18.3 Exceptions. Either of us may bring an individual claim in small claims court instead, if it qualifies. Either of us may also ask a court for an injunction or other equitable relief to protect intellectual property rights.

18.4 Class action and jury waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY. If this paragraph is found to be unenforceable, then the whole of Section 18.2 is void, and any dispute proceeds in court under Section 19.

18.5 Coordinated filings. If 25 or more similar claims are brought against us by or with the help of the same law firm or coordinated group, the claims will be arbitrated in batches of no more than 50, with one arbitrator per batch, and the time limits for all claims in the queue are paused until that claimant's batch is reached.

18.6 Your right to opt out. You may opt out of Section 18.2, 18.4 and 18.5 by emailing info@berstukstore.com with the subject line "Arbitration Opt Out" within 30 days of first agreeing to these Terms. The email must give your name and the email address associated with your account or order. Opting out of arbitration does not affect any other part of these Terms, and we will not treat you any differently for doing it.

SECTION 19 - GOVERNING LAW AND VENUE

These Terms and any separate agreement under which we provide you with services are governed by the laws of the State of Texas, without regard to its conflict of law rules, and by applicable federal law of the United States. Where a dispute is not subject to arbitration under Section 18, you and we agree to the exclusive jurisdiction of the state and federal courts sitting in Dallas County, Texas, and each of us waives any objection to venue there. Nothing in this section deprives a consumer of the protection of mandatory provisions of the law of the place where they live.

SECTION 20 - ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms and any policies or operating rules posted by us on this site are the entire agreement between you and us, and they supersede any prior agreements, communications and proposals, whether oral or written, including any earlier version of these Terms. Any ambiguity in the interpretation of these Terms will not be construed against the drafting party.

SECTION 21 - CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of them by posting the change here. It is your responsibility to check this page periodically. Your continued use of the site after a change is posted constitutes acceptance of that change. A change to Section 18 does not apply to any dispute of which we have already received notice.
